The challenge only grows when calculating the regular rate of pay for employees earning salary and commissions/bonuses, which requires careful attention and an understanding of the formulae. This is ultimately one of the more fundamental wage and hour compliance issues but getting it wrong can be costly as the law provides for back pay, penalties, interest, attorneys’ fees and costs and potential class or collective action liability.
